About these terms

These terms apply to your use of the Orkia Solutions website. Where you engage us for software or services, the specific commercial terms for that work are set out in the proposal and service agreement we sign with you. Where the two differ, the signed agreement takes precedence.

Using this website

• The content of this website is provided for general information about our products and services.
• We aim to keep it accurate and current, but we do not guarantee that every detail is complete or up to date at all times.
• Descriptions of software capabilities are general. What is included in your implementation is what is set out in your proposal.
• Please do not attempt to interfere with the operation or security of this website.

Proposals and pricing

Prices are not published on this website because they depend on scope. Any figure we provide is given in a written proposal, is valid for the period stated in it, and is subject to the assumptions recorded in it. Taxes are applied as required by law.

Services

Work is carried out according to the scope agreed in writing. Where you ask for changes beyond that scope, we will tell you what the change involves and what it costs before we proceed. Timelines given in a proposal assume that information, approvals and access we need from you arrive when expected.

Software licences

Software supplied by Orkia Solutions is licensed to you for use in your business on the terms set out in your agreement. It is not sold, and it may not be resold, sub-licensed, copied or reverse-engineered without our written permission.

Your data and your responsibilities

You are responsible for the accuracy of the data you enter into the software, for keeping your account credentials secure, and for the actions of the users you authorise. You are also responsible for ensuring your use of the software complies with the law, including any rules that apply to sending marketing messages.

Messaging and campaign services

Where you use our SMS, voice or email tools, you are responsible for having the right to contact the people on your list and for complying with all applicable regulations, including registration and consent requirements. We may suspend a service where we believe it is being used unlawfully.

Intellectual property

The Orkia Solutions name, logo, website content and software remain our property. Material you provide to us, such as your logo and content, remains yours.

Availability and liability

We work to keep our services available, but no software or internet service is available without interruption. We are not liable for indirect or consequential loss, including loss of profits or business interruption. Nothing in these terms limits liability where it cannot lawfully be limited.

Governing law

These terms are governed by the laws of India, and the courts at Bikaner, Rajasthan have jurisdiction.

Changes

We may update these terms. The version published on this page is the one that applies.
